Terms of Sales

PREAMBLE

The Owlin brand is a trademark that was the subject of a trademark registration application in BOPI No. 19/27 Vol. I of July 5, 2019. The brand is operated by SAS Owl Sport, with a capital of €3,000.

OBJECT

For any order placed from the website www.owlin.cc , a sales contract is concluded, which will be governed by these General Terms and Conditions quoted below.

These terms and conditions apply to all sales made on the website www.owlin.cc and constitute an agreement between Owl Sport, hereinafter referred to as "Owlin," and any individual wishing to make a purchase via the website www.owlin.cc , hereinafter referred to as "the buyer." The buyer fully and completely accepts these terms and conditions when placing an order on the website. Owlin reserves the right to modify its terms and conditions of sale at any time. In this case, the applicable terms and conditions will be those in effect on the date the order is placed by the buyer.

TERMS OF SALE AND ORDERS

The buyer must be at least 16 years old to purchase products on www.owlin.cc . Orders may only be placed on this website by consumers, not resellers. The buyer guarantees that the information provided to Owlin when placing the order is accurate and complete.

All information provided on the website www.owlin.cc is for informational purposes only. Owlin.cc reserves the right to review and refuse any order at any time, without liability. An order will be considered refused if it is not confirmed within ten business days.

All orders are subject to our approval. We reserve the right, at our sole discretion, to refuse an order if, for example:

- Some products shown on the website are not available;

- If we are unable to obtain authorization for your payment;

- If delivery restrictions apply to a product.

Once the order has been placed, we will send an order confirmation email with the order number, details of the products ordered, and delivery information.

To place an order, the buyer must have an email address. It may be necessary to configure their browser to accept both (functional) cookies and pop-up windows in order to use all the features of the www.owlin.cc website, including adding items to their cart and making a purchase.

PLACE AN ORDER

To place an order on the website www.owlin.cc , the buyer must:

- Enter your email address and delivery information

- Confirm the contents of your order after checking it

- Make the payment under the conditions stipulated

- Confirm your order and payment.

Order confirmation implies acceptance of these terms and conditions of sale, acknowledgement of having read and understood them fully, and waiver of any right to invoke one's own terms of purchase or any other conditions. All data provided and the recorded confirmation will serve as proof of the transaction. Confirmation will constitute signature and acceptance of the transactions carried out.

ORDER CANCELLATION

Since your order is processed as soon as it is received, it is not guaranteed that we will be able to cancel it.

PRODUCT QUALITY AND MAINTENANCE

The product photos on www.owlin.cc are as accurate as possible. However, display technologies or other technical factors may cause slight variations in color or material appearance. Owlin cannot be held responsible for any such differences.

Please note the washing and care instructions on the product labels and on the dedicated page. Owlin cannot be held responsible for any damage resulting from improper handling of the products or from handling that does not comply with these instructions.

LEGAL GUARANTEES

All items offered by www.owlin.cc are subject to the legal guarantee provided for in Articles L221-1 et seq. of the Consumer Code and to the guarantee against hidden defects provided for in Articles 1641 et seq. of the Civil Code.
The customer has two (2) years to claim either of these guarantees.
For non-conformity, the time limit runs from the date of delivery.
For hidden defects, the time limit runs from the discovery of the defect.
If the apparent defect, non-conformity or hidden defect of the item, declared by the customer, as applicable, is proven, after expertise has been made, Owlin undertakes to reimburse the customer at the latest within fourteen (14) days.

All return requests due to defects must first be validated by customer service via photos of the problem. If the defect is validated by customer service, a return label will be provided to the customer to return the product. The product will be exchanged subject to availability. If an exchange is not possible, the customer will be refunded. Any item returned without prior validation by customer service will be considered damaged by the customer and will not be refunded.

Owlin cannot be held responsible for the misuse and/or intensive use of the items by the customer.

SITE AVAILABILITY

We do not guarantee that the website, or any content contained therein, will always be accessible or uninterrupted. Access to the website is permitted on a temporary basis. We may suspend, remove, discontinue, or modify all or part of the website without notice. We will not be liable to you for any unavailability of the website, for any reason whatsoever, at any time and for any duration.

DELIVERY

Owlin ships its parcels within mainland France via La Poste or Mondial Relay and offers you 2 delivery options:

- Collection from a Mondial Relay collection point

- To your delivery address (no deliveries on Saturdays)

Delivery takes place within 48 to 72 hours from order processing, Monday to Friday. Your phone number is required to ensure successful delivery of your package if you have selected home delivery. We are not responsible for any delays in delivery (particularly in the event of strikes, loss, or damage caused by the carrier), as these delivery times are estimates only and should not be considered guaranteed. Exceeding these delivery times does not entitle you to any form of compensation.

Delivery times for personalized products (markings) will be longer due to the additional time required to complete the marking.

Owlin is not responsible for parcels that have been recorded as missing after delivery by the carrier.

Refunds or returns will be handled on a case-by-case basis.

In case of any post-registration problems, please contact the carrier directly.

Shipping costs and terms

Delivery charges are determined based on the chosen delivery method (collection point or home delivery), the order amount, and the shipping zone. Available delivery options and their prices are displayed at the time of order confirmation.
In mainland France, delivery to a collection point is free for orders over €50, or for orders under a lower amount during temporary promotional offers. Home delivery charges vary depending on the carrier and the shipping option selected by the customer; please see the details at checkout.

DELIVERY TRACKING

To track your order, please refer to the "Track my package" section on the sender's website and enter your tracking number (which will have been sent to you by email when your order was shipped).

For deliveries made to a collection point, a message will inform you of the availability of the parcel at the collection point you have selected.

EXCHANGES AND RETURNS

You have thirty (30) days from the date of receipt of the package to withdraw from the contract. Here are the steps to follow and the conditions to be met:

- Thirty (30) day period after receipt of the package

- Product returned new, unworn and unused, in its original packaging in perfect condition with tags attached

If both of these conditions are met, you need to contact us to obtain the return form.

Noticed :

Personalized products cannot be returned.

Only products purchased on www.owlin.cc can be returned through the online return process. Items that do not meet this criterion cannot be returned to the sender.

If your return meets the acceptance conditions, you will be refunded the amount of the returned item, with shipping costs remaining the responsibility of the seller.

The refund will be made to the bank card used for the initial payment upon receipt of the returned products, after verification of their condition and in accordance with the conditions indicated above.

Following this refund, if you wished to exchange the item, you can place a new order on the website for the item you want.

Beyond the 30-day period, no item can be returned or exchanged.

DISPUTES

Disputes arising from the application of these general terms and conditions of sale are subject to French law.

RIGHT OF WITHDRAWAL

The consumer has a period of thirty (30) days to exercise their right of withdrawal, without having to justify their decision or pay any penalties. This period is twenty clear days from the date of receipt of the goods.
