PREAMBLE

The Owlin brand is a brand which has been the subject of a trademark registration application in BOPI No. 19/27 Vol.I of July 5, 2019. The brand is operated by SAS Owl Sport, with capital of 3000 €

OBJECT

For any order placed from the site www.owlin.cc , a sales contract is concluded, which will be governed by these General Conditions cited below.

These are applicable to all sales made on the site www.owlin.cc and conclude between the company Owl Sport on the one hand, hereinafter referred to as “Owlin” and any natural person wishing to make a purchase via the website www.owlin.cc on the other hand, hereinafter referred to as “the buyer”. The latter fully and completely adheres to these general conditions when ordering on the site. Owlin reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

CONDITIONS OF SALE AND ORDERS

The buyer must be at least 16 years old to purchase products on www.owlin.cc . He can only order from this store if he is a consumer and not a reseller. It guarantees that the information provided to Owlin when ordering is accurate and complete.

Any information given on the site www.owlin.cc is for information purposes only. Owlin.cc reserves the right, at any time, to verify an order and possibly refuse it, without liability. The order will be considered refused if it is not confirmed within ten working days.

All orders are subject to our approval. We reserve the right, in our sole discretion, to refuse an order if, for example:

- Products presented on the website are not available;

- If we are unable to obtain authorization for your payment;

- If delivery restrictions apply to a product.

Once the order has been placed, we will send an order confirmation email with the order number, details of the products ordered and delivery information.

To place an order, the buyer must have an email address. It may be necessary to configure your browser so that it accepts both (functional) cookies and pop-up windows to be able to use all the features of the site www.owlin.cc , in particular the adding an item to your cart and making a purchase.

PLACE ORDER

To place an order on the site www.owlin.cc , the buyer must:

- Enter your email address and delivery information

- Validate the content of your order after checking it

- Make payment under the conditions provided

- Confirm your order and payment.

Confirmation of the order entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them and renunciation of relying on one's own conditions of purchase or other conditions. All the data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions.

CANCELLATION OF THE ORDER

As your order is processed upon receipt, it is not guaranteed that we will be able to cancel it.

PRODUCT QUALITY AND MAINTENANCE

The photos of the articles on the site www.owlin.cc provide information as faithful to reality as possible. However, it is possible that display technologies or other technical reasons may result in slight nuances in color or material appearance in the products. Owlin cannot be held responsible for any differences observed.

We draw your attention to the washing and maintenance instructions appearing on the product labels, as well as on the dedicated page. Owlin cannot be held responsible for any damage resulting from improper treatment of the products, or resulting from treatment not in accordance with these instructions.

LEGAL GUARANTEES

All items offered by www.owlin.cc are subject to the legal guarantee provided for by articles L221-1 et seq. of the Consumer Code and to the guarantee against hidden defects provided for by articles 1641 et seq. of the Civil Code.
The customer has two (2) years to assert one or other of these guarantees.
For lack of conformity, the time limit runs from delivery.
For hidden defects, the period runs from the discovery of the defect.
If the apparent defect, the lack of conformity or even the hidden defect of the item, declared by the customer, if applicable, is proven, after assessment, Owlin undertakes to reimburse the customer at the latest within fourteen (14 days.

Any return request for defects must be previously validated by customer service by sending photos of the problem raised. If the defect noted is validated by customer service, a return label will be provided to the customer in order to return the product. The product will be exchanged while stocks last. Otherwise, the product will be refunded to the customer. Any item returned without prior validation from customer service will be considered damaged by the customer and will not be refunded.

Owlin cannot, however, be held responsible for the misuse and/or intensive use of the items that the customer may make of them.

SITE AVAILABILITY

We do not guarantee that the website, or any content appearing on it, will always be accessible or uninterrupted. Access to the website is authorized on a temporary basis. We may suspend, delete, interrupt or modify all or part of the website without notice. We will not be held liable to you in the event of unavailability of the website, for any reason whatsoever, at any time and for any duration.

DELIVERY

Owlin ships its packages to mainland France with the post office or Mondial Relay and offers you 2 delivery choices:

- Collection at Mondial Relay relay point

- To your delivery address (no delivery on Saturdays)

Delivery takes place within 48 hours or 72 hours from the processing of your order, Monday to Friday. Your telephone number is necessary to ensure proper receipt of the package if you have selected delivery to your address. We decline all responsibility for the extension of delivery times (in particular in the event of a strike, loss or damage caused by the carrier) which are given as an indication and should not be considered as firm deadlines. Exceeding these deadlines does not entitle you to any form of compensation.

Delivery times for personalized products (markings) will be longer given the additional time required to complete the marking.

Delivery terms to other countries can be found in Appendix 2 “Shipping areas and delivery costs”.

Prices

The delivery rate for orders depends on the amount of your order and the shipping zone. When confirming your order, the delivery options and their prices will be clearly indicated and shown on your invoice. In mainland France, shipping costs are €6, but they are free from €100 of purchase.

DELIVERY TRACKING

To track your order, please refer to the “Track my package” section on the sender’s website and provide your tracking number (which will have been sent to you by email when your order is shipped).

For deliveries made to a relay point, a message will inform you of the availability of the package in the relay point you have selected.

EXCHANGES AND RETURNS

You have thirty (30) days after the date of receipt of the package to withdraw. Here is the procedure to follow and the conditions to respect:

- Deadline of thirty (30) days after receipt of the package

- Product returned new, unworn or used, in its original packaging in perfect condition with tags attached

If these two conditions are met, you must contact us to obtain the return form.

Noticed :

Personalized products cannot be returned.

Only products purchased on www.owlin.cc can be returned through the online returns process. Items that do not meet this criteria cannot be returned to sender.

If your return meets the acceptance conditions, you will be reimbursed for the amount of the returned item, with shipping costs remaining the responsibility of the seller.

The refund will be made to the bank card used for the initial payment upon receipt of the returned products, after verification of their condition and in accordance with the conditions indicated above.

Following this refund, you will be able, if you wanted an exchange, to reorder on the website for the item you want.

Beyond the 30-day period, no item can be returned or exchanged.

DISPUTES

Disputes arising from the application of these general conditions of sale are subject to French law.

RIGHT TO RETRACT

The consumer has a period of thirty (30) days to exercise his right of withdrawal, without having to justify or pay penalties. This period is twenty clear days from receipt of the goods.
